Welcome to WhaoApi. These Terms of Use govern your relationship with the WhaoApi WhatsApp Business management platform. Please read them carefully before using the platform.

1. Acceptance of Terms

  • By using the WhaoApi platform you agree to be bound by these terms and conditions.
  • If you use the platform on behalf of a company or organization, you represent that you are authorized to accept these terms on its behalf.
  • We reserve the right to modify these terms at any time, with notice of material changes.

2. Service Description

  • WhaoApi is a platform for managing WhatsApp Business conversations through Meta's WhatsApp Cloud API.
  • The service includes: conversation management, team setup, automated replies, sending templates and bulk messages, and analytics.
  • The service depends on the WhatsApp Business API. WhaoApi is not responsible for changes or outages on the part of Meta or WhatsApp.

3. Accounts & Registration

  • Information provided at registration must be accurate and correct.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate your account if you violate these terms.

4. Acceptable Use

  • The platform must be used in compliance with WhatsApp Business policies and Meta's commercial policies.
  • Prohibited: sending unsolicited or spam messages.
  • Prohibited: using the platform for illegal or fraudulent purposes.
  • Prohibited: attempting unauthorized access to the platform's systems or other users' data.
  • Prohibited: reselling or leasing the service without prior authorization.
  • You are responsible for the content you send via the platform and it must comply with applicable laws.

5. Subscriptions & Payment

  • The platform offers a 3-day free trial before the paid subscription begins.
  • Subscription prices are published on the website and may change with prior notice.
  • Payment is made in advance for the selected period (monthly or yearly).
  • Refund policy: you may request a full refund within 3 days of the payment date. After this period a refund is not available. To request a refund, contact us at info@whao.tech.

6. Limitation of Liability

  • The service is provided "as is" without express or implied warranties.
  • We are not liable for any direct or indirect damages arising from your use of or inability to use the platform.
  • We are not liable for service interruptions caused by WhatsApp API or Meta outages or circumstances beyond our control.
  • We are not liable for data loss caused by misuse or external factors.

7. Intellectual Property

  • All intellectual property rights in the platform — including design, code, and trademarks — are owned by WhaoApi.
  • Users are granted a limited, non-exclusive license to use the platform during the subscription period.
  • Users may not copy, modify, or distribute any part of the platform.

8. Termination

  • You may cancel your subscription at any time by contacting us at info@whao.tech.
  • We reserve the right to terminate or suspend your account immediately if you violate these terms.
  • Upon termination you will lose access to your account and data in accordance with our data retention policy.

9. Governing Law

  • These terms are governed by the laws of the Kingdom of Saudi Arabia.
  • Any dispute arising from use of the platform is subject to the jurisdiction of the competent courts in the Kingdom of Saudi Arabia.
